To ask the Minister for Infrastructure whether he has plans to use the developer bond to complete the West Strand Road, Portrush, given the difficulties currently faced in its completion.

West Strand Road, Portrush remains unadopted as the developer has not completed the streets. There are difficulties associated with the bond of surety, the road layout, and the landowner of the road. The bond agreement does not specify a particular time period for the developer to complete, however, my Department will continue to encourage the developer to bring the road to an adoptable standard.
The Department has no current plans to call in the bond, however, may consider enforcement to complete pre-adoption repairs if the developer defaults in his responsibility. The Department is not obliged under The Private Streets (Northern Ireland) Order 1980 to serve notice or carry out any enforcement actions necessary to bring a development up to an adoptable standard, whether the developer is trading or dissolved. The powers to serve notice and undertake works are discretionary.
